Re: Employee Misconduct GS-15 and Above
For over ten (10) years, I was an employee in good standing; I rose from the bottom, GS-3 to GS-10 supervisor; I hold a master's degree in Economics. After five (5) weeks on the job as supervisor, I was demoted to frontline management because I questioned directives that were discriminatory in nature and impact. I have been subjected to discrimination my entire life, the fact that I was being discriminated against did not disturb me as much as the fact that I was being directed to discriminate against others. As an economist, I find such workplace discrimination extremely inefficient. Far too much of an organization's resources is spent servicing labor relations disputes, little else gets done. Management certainly cannot be addressing grievances and planning or performing other important management functions simultaneously. More important than the time lost in productive management activities, there is the loss in productivity due to declining employee morale. When employees are subjected to discrimination, harassment and retaliation to the degree I witnessed and endured, productivity is bound to be low, because employee morale resides on the floor. The Atlanta Service Center (ATSC) where I worked is such a place where this type of inefficiency runs amok. At the time of my demotion, ATSC was ranked ten (10) among an equal number of centers.
In order to promote the efficiency of the Service, I questioned LuRae Buchalski's treatment of employees and her discriminatory directives. As a Christian, to obey Buchalski's directives went against every ethical principle my faith and the Service seeks to impart to its employees in Ethics in the Workplace workshops. I should know because I helped facilitate these workshops at the Atlanta Service Center. Everything the Service teaches its employees means nothing when a vindictive management decides to punish an employee for questioning discriminatory actions. This is precisely what happened to me. Rather than answering the questions raised in the attached memorandum dated March 22, 1997, LuRae Buchalski, with malice of forethought, deviously demoted me through an arbitrary reassignment to front line management. Today, the questions I raised remain unanswered and largely ignored by upper management in its blind haste to provide unconditional backing for one of its own, LuRae Buchalski. By getting rid of me, Buchalski has avoided the issues. Upper management provided its unconditioned support sanctioning and justifying her asinine actions, up to and including giving others the impression I failed to perform the duties of my position as substantiation for the reassignment/demotion.
I realize, in the grand scheme of things, your office could care less about a complaint of upper management discrimination. However, my complaint centers on inefficiency in what I believe is ongoing harassment. Nothing could be more wasteful than six (6) high-ranking IRS employees appearing at a single employee's unemployment compensation hearing. This is precisely what happened at my appeal hearing on January 9, 1998 with the Georgia Department of Labor. I do not believe even the IRS would devote this much manpower to handling unemployment compensation appeals on a normal basis. I hope this is an isolated situation for the sake of tax dollars being squandered in this manner. If this is not standard procedure, then I am the subject of ongoing harassment by ATSC upper management. Participating in this inefficient use of government resources are Dick Marsh, the Atlanta Service Center via his assistant Bobby Hunt, Paul McDonald, Customer Service Division Chief, LuRae Buchalski and Carol Meyers, both Branch Chiefs, Nancy Hamilton, Labor Relations Specialist and the Frick Company Attorney, Clarence Thompson. I do not believe the Service sanctions as standard business practice sending six (6) high-ranking officials to these hearing to deny one former employee unemployment compensation.
Because I am firmly convinced this is not an approach that would be assumed by an ethical organization, I am just as convinced the IRS does not approve. Even unprincipled organizations would want to eliminate such a waste of valuable limited resources. I respectfully request that your office investigate ATSC unemployment claims processing practices for waste and abuse of tax dollars. If you require additional information, do not hesitate to contact me. I am at your disposal in this matter, because I am convinced it strikes at the heart of where real IRS reform needs to occur.
